Farmers whose farms are located in the temporarily occupied territories found themselves in a difficult situation due to the uncertainty of the legislation. On the one hand, their economic activity can be considered as a crime, on the other hand, agricultural enterprises can be nationalized by the authorities of the Russian Federation.
The UAC member from the south of Kherson region, the head of one of the agricultural enterprises, who cannot be called for known reasons, said:
"Nowadays we are in a situation of misunderstanding - where is the limit of work, and where is the limit of collaboration. Everyone hopes for the victory of the Armed Forces of Ukraine and the return of the southern territories, that we will drive occupiers out of our land. But the occupying authorities set a deadline of September 1 - by this date, enterprises must be registered, or their property will be nationalized by the Russian Federation. There are farms whose owners have left the region, it is even more difficult for them. In the occupied territory, registration of the enterprise is possible only with the participation of the owner, if the owner does not appear personally, then it is nationalized."
Most of the farms, whose owners have not left Ukraine and carry out agricultural activities, belong to small land users who cultivate from 20 to 1000 hectares. Currently, they need the adoption of the Draft Law on Amendments to the Law of Ukraine "On Ensuring the Rights and Freedoms of Citizens and the Legal Regime on the Temporarily Occupied Territory of Ukraine" regarding the peculiarities of activities in the temporarily occupied territory of Ukraine No. 7646, which is supported by the UAC.
"There are many farms in the region whose owners have stayed there and work on the land - they are small ones and cultivate from 20 to 1000 hectares - there are a lot of them. Farmers nowadays do not understand what to do. It is they who need a signal from the state. The state must show that there is a limit: if you were forced to register it, because otherwise your property will be taken away, then such a registration is not a crime and such a farmer does not fall under the law on collaboration. But if you do all this freely - that's a different matter. Now it's quite difficult to draw a line between freely and forcedly activity," said the farmer from Kherson region.
It is important that the relevant law was adopted by Ukraine before September 1, as there is a risk that many Ukrainian enterprises will be nationalized by the Russian authorities.
"The draft law №7646 will not solve all problems, but the law will send a clear message that ordinary activities in case of danger to the property and life of the farmer are not criminal ones. The economic activity cycle is over, the producers have stocks of grain and they don’t know where to sell it. And this is good for the occupiers, who will take everything, take it away, and make money. And the local population will be left with nothing," summed up the Agricultural Enterprise from Kherson region.
