
The Ukrainian Agrarian Council (UAC) together with people's deputies prepared an appeal to the Constitutional Court regarding the illegality of the adopted norms of non-reimbursement of VAT when exporting oilseeds.
Mikhail Sokolov, the Deputy Chairman of UAC, pointed this in the framework of the V International Conference of Agricultural Investors Agri Invest Forum on May 16 in Kyiv.
"We, together with people's deputies, prepared an appeal to the Constitutional Court. If the law was adopted in violation of the rules, it can not be voted and can be canceled. When deputies adopted amendment regarding the cancellation of export VAT refunds for oil, the regulation was violated at every stage of the vote. Therefore, we ask the Constitutional Court to consider and cancel this amendment ", - noted Sokolov.
It is necessary to collect at least 45 signatures of people's deputies to send a corresponding appeal.
Ivan Miroshnichenko, People's Deputy and member of the Verkhovna Rada Committee on Agrarian Policy and Land Relations, said that the Samopomich fraction supports the relevant appeal to the Constitutional Court.
"I support the appeal to the Constitutional Court - you already have 24 signatures from the Samopomich faction. I think that we will collect 45, and even more ", - said the People's Deputy.
According to Miroshnichenko, tomorrow, on May 17, an internal parliamentary agrarian committee will hold a meeting. During the meeting he, together with a People's Deputy from the faction "Volya Narodu" Sergei Labazyuk, will urge the people's constituents to send an appeal to President Petro Poroshenko and Minister of Ukraine Volodymyr Groisman with a request to make a decision on "soy amendments".
In addition, Miroshnichenko suggests referring to the embassies of the European Union, the United States, as well as to the representative offices of international financial organizations, expert opinions on the consequences of adopting “oil amendments”.
According to the estimates of the UAC, the losses of small and medium-sized farmers will reach over UAH 8 billion as a result of "oil amendments".
Non-reimbursement for the export of certain categories of goods is a manifestation of tax discrimination and a violation of the basic principle of the Tax Code of Ukraine - the equality of all payers before the law, regardless of the type of activity. In addition, this norm is also a gross violation of the commitments made by Ukraine in its WTO accession and signing the EU association agreement
Тomorrow, on May 17, the Verkhovna Rada plans to consider draft law No. 7403-2, which abolishes the rules on non-reimbursement of VAT when exporting soybeans and canola. However, this bill once again stands in the "impassable" part of the agenda.
If the deputies once again ignore the demands of the farmers and do not vote for the refund of VAT refunds when exporting oilseeds, agricultural producers will continue large-scale protests throughout the country.
