Ukrainian Agri Council (UAC) appealed to President Volodymyr Zelenskyi, Chairman of the Verkhovna Rada of Ukraine Dmytro Razumkov and all parliamentary factions and groups to adopt in the second reading and as a whole the draft law №2194 on improving the system of management and deregulation in land relations sector. The document provides for the transfer of state-owned agricultural land outside the settlements to the communal property of communities.

The appeal emphasizes that communities have been waiting for the adoption of this bill for a long time. After all, in matters of land management of communities outside the settlements, there are many problems that stop the development of democracy on the ground. These are, in particular: distribution of land to the third persons without taking into account the interests of the population of communities, impossibility to simply and legally define the boundaries of community territories, burdensome, non-transparent procedures for approving land management documentation and establishing land boundaries.

The norms of the draft law №2194 will regulate these controversial points and provide for:

  • resolving the issue of land property, simplifying access to land resources for the people, business by revoking unnecessary permits and duplicating procedures for verifying land management documentation;
  • providing information on land management documentation of the status of public, open and publicly available data;
  • introduction of professional liability insurance for land management contractors;
  • reduction of the cost of works and duration of time spent on the implementation of procedures related to land management;
  • establishing boundaries between community territories by agreement of communities;
  • approval by local councils of detailed plans of the territory within and outside the settlements;
  • strengthening the role of territorial communities in monitoring the state of land use;
  • the opportunity to monitor publicly the fate of the land from the moment of granting permission for its allocation;
  • fixing the boundaries of land plots with the consent of their land owners without unnecessary bureaucracy, etc.

"It is important that the state authorities, perhaps for the first time, try to solve outdated problems fully and comprehensively, demonstrating the true European format of honest and transparent relations between the state and the population who are united in territorial communities".
