In the conditions of a full-scale military invasion of Russia against Ukraine, it is extremely important to document crimes and record losses caused to Ukrainian businesses, for further compensation. That is why experts of the Ukrainian Agri Council together with the USAID Program for Agrarian and Rural Development (AGRO) joined the round table "Destroyed agricultural enterprises: fixation of losses and prospects for their compensation" organized by the Ministry of Agrarian Policy and Food of Ukraine.
"Great attention to this topic and almost three hundred participants of the meeting confirm its relevance. We, as the Government, will do everything necessary to ensure that all compensations for the damages caused to Ukrainian farmers are paid. They will be compensated by the aggressor country. It can be frozen funds of the Russian Federation or direct reparations, but in order for us to succeed legally, Ukrainian farmers need to have a common and correct algorithm for fixing losses. In the future that will help to win court cases, including in international courts," stressed Deputy Minister of Agrarian Policy and Food of Ukraine Taras Vysotskyi.
During their speech, experts of the UAC together with the USAID Program for Agrarian and Rural Development (AGRO) provided practical pieces of advice to harmed enterprises and presented developed methodological recommendations for documenting the losses of agrarian companies.
"It is very important for farmers to know and feel that they are not left alone with their problems in war conditions. The Ministry, associations and international organizations continue to work for farmers. Damage documentation is an important tool nowadays that will allow you to recover money for lost property and lost farm profits. All Ukrainian farmers should clearly know what to do and how to properly collect documents for further trials in case of trouble. All farmers should know that in Ukraine, international law will protect them, even those who are on the occupied territories," said Serhiy Kubakh, Head of Land Reform, USAID AGRO Project.

"In the package of presented documents, you will find: universal recommendations for fixing damage to objects as a result of Russia's military aggression and a step-by-step procedure for collecting evidences. In addition, our experts, taking into account current legislation and practical experience, have prepared document templates that will be useful when documenting losses. Particular attention in the methodological recommendations is devoted to documenting damages caused to landowners and land users, lost profits and, of course, to the peculiarities of documenting losses in temporarily occupied territories," said expert on legal and regulatory issues of the UAC Victoria Kipriianova.
It is important to note that even in the conditions when the war is not over, it is necessary to take care of the proper legal basis for compensation of damages in advance.
"You should put your assets in order, correctly register all movable and immovable property, collect technical documentation, i.e. everything you need in case it is necessary to record the damage caused. You should also take care of fixing the lost profit, if it happened at the enterprise. To collect the concluded contracts for the supply of products and properly store them and their copies separately," said Anna Fedun, legal advisor of the USAID Program for Agrarian and Rural Development (AGRO).
