A farm has appeal to the legal advisory service of the UAC with a request to help in a situation where, in their opinion, employees of the military office exceeded their official duties and to help with the assessment of those actions.
"Several employees of the Military Office arrived at the location of the farm. When they were denied entering the territory, they still penetrated and tried to hand a draft notice that obliged to come to the Military Office for a military medical commission. Despite the resistance and unwillingness to sing the documents without the head of the farm, the Military Officials used physical force with some employees. Moreover the they conducted an inventory of farm equipment".
First of all, it is worth noting that the actions of military officials are obviously illegal and can be considered within the Criminal Code of Ukraine.
In particular, the fact of illegal penetration into the farm can be subsumed under part 2 of art. 162 of the Criminal Code of Ukraine, as illegal entry into a home or other property of a person, illegal inspection or search.
At the same time, the circumstances of the use of physical force against the company's employees can be qualified under part 2 of art. 126 of the Criminal Code of Ukraine, as a deliberate hitting, beating or committing other violent actions that caused physical pain and did not cause bodily harm, committed by a group of people.
At the same time, the doctor's confirmation of bruises can be grounds to determine it as body injuries (art. 125 of the Criminal Code of Ukraine).
