
In February last year, the government adopted decrees, which changed the procedure for distributing subsidies in support of agrarian business. The resolutions were adopted on the basis of a legal act prepared by the Office of Maxim Martynyuk in violation of the procedure of adoption.
On March 29, there was hels a court hearing on the case. Lawyers of UAC filed additional explanations and comments on violations of the Cabinet of Ministers procedure for the adoption of a regulatory act. Thus, the government resolutions of February 7, 2018 were adopted on the basis of documents dated later - on February 16 and 21, last year. Therefore, the decrees were legally invalid.
"We appealed three decisions of the Cabinet of Ministers. It filed a denial to our suit, to which were attached the documents that served as the basis for the adoption of resolutions. The Cabinet of Ministers established that the mandatory documents for the adoption of a regulatory act is an explanatory note, a certificate to the Ministry of Justice, a certificate of approval with other state bodies, etc. But these documents were submitted after the adoption of the decisions itself, which violates the regulations", - explains the lawyer Yana Krokhmaliova.
In addition, in the court there was discovered the fact that that the Martyniuk team was subjected to fraud. His agency, as the main developer of the act in the certificate of approval, noted that the Ministry of Economic Development and Trade (MEDT) did not comment, and therefore the project was agreed by default. But this was denied in court. In response to a request from the MEDT, he explained that he had appealed to the "agrarian" ministry on February 6, the day before the adoption of the resolutions, and later sent his remarks to them, stating that the projects need to be finalized. Thus, the MEDT caught M. Martynyuk's leadership in a lie. The next court hearing is scheduled for May 31, 2019.
"This is a long history. Last year, the ministry developed the procedures and approved it in violation of the rules, without discussing it with anyone. We decided to punish him and file a lawsuit. And now the court began to consider the case. It becomes obvious that the Ministry of Agrarian Policy has violated the regulations and moreover, it lies in the court," says Mikhail Sokolov, deputy head of the UAC.
We remind that the adoption of government decisions led to a real reduction in subsidies to support the agrarian sector in 2018 and unfair redistribution in favor of big business.
