Recently, some media outlets reported that periodic technical inspections of the suitability of technical equipment for the agro-industrial complex are returning to Ukraine. The authors of the publications refer to the fact that such a norm is provided for in the first reading of the draft law №6070.
The specialists of an analytical center “Smart Country” analyzed the situation and found that the journalists made a mistake. The draft law №6070-1 was adopted as a basis, which does not contain direct norms on the periodicity and frequency technical control for agricultural machinery.
Moreover, the current legislation in Ukraine also does not provide for the periodicity of assessment and confirmation for the operation of agricultural and forestry tractors.
However, such an obligation may be implemented if it is provided for by an international agreement of Ukraine, the binding nature of which has been approved by the parliament.
Currently, according to paragraph 1 of Article 5 of Directive 2014/45/EU, there are a number of technical, time requirements for periodic technical inspections of vehicles and checking their suitability for usage. Such vehicles include T5 wheeled tractors, which are mostly operated on public roads with a maximum designed speed of over 40 km/h.
In such circumstances, amendments to the periodic technical inspection of vehicles and the verification of their suitability for operation may be submitted before the second reading of the draft bill №6070-1.
However, the specialists of the analytical center "Smart Country" will do everything possible to prevent this from happening.
