Transportation of dangerous goods falls under extremely stringent regulation, since an error in this area can have catastrophic consequences. At the same time knowledge of the norms of the current legislation will help not only to avoid problems with the supervisory authorities, but in some cases even to preserve human life.

According to the annex to the Law "On Pesticides and Agrochemicals", ammonium nitrate refers to agrochemicals authorized for import into the customs territory of Ukraine, for its production, trade, use and advertising without its state registration.

What is the procedure for obtaining permission to work related to the transportation, storage, use and trade of agrochemicals?

Persons, whose activities are related to the transportation, storage, use of pesticides and agrochemicals and their trade, must have a permit (certificate) for the right to work with the specified pesticides and agrochemicals. The procedure for obtaining such admission is determined by the Cabinet of Ministers of Ukraine.

In accordance with Article 11 of the Law "On Pesticides and Agrochemicals", the Cabinet of Ministers of Ukraine by Resolution No. 746 of September 18, 1995 approved the "Procedure for obtaining a permit (certificate) for work rights associated with transportation, storage, use and trade of agrochemicals and pesticides" (hereinafter - the Procedure No. 746).

In accordance with clause 3-8 of Procedure No. 746, the admission is issued by the state phytosanitary inspections in the form in accordance with Annex 1 to Procedure No. 746. The reason for issuing the admission is a certificate of passing special training on the safe performance of work with pesticides and agrochemicals in accordance with Annex 2 to Procedure number 746 and a medical book with the conclusion of the medical commission on the absence of contraindications for health according to Annex 3 to Procedure No. 746.

What are the requirements to drivers of vehicles during transportation of cargoes with ammonium nitrate?

A driver of a vehicle carrying a load of ammonium nitrate must:

• obtain a permit (certificate) for the right to work with the specified pesticides and agrochemicals;
• have a medical book with the conclusion of the medical commission about the absence of contraindications for health reasons to carry out such activities.

What is the responsibility of carriers of dangerous goods?

Article 8 of the Law "On the Transport of Dangerous Goods" defines the following obligations of carriers:

• to have a license for the right to conduct business activities on the internal carriage of dangerous goods;
• to ensure inspection of vehicles by territorial bodies of the Ministry of Internal Affairs of Ukraine
• to obtain an appropriate certificate of admission to the carriage of dangerous goods;
• do not deviate from the agreed route, during transportation;
• to observe safe traffic conditions;
• to provide special training, improvement of professional skills and medical examination of persons carrying out transportation of dangerous goods;
• to ensure that drivers receive certificates of admission to the transport of dangerous goods of a prescribed standard after training and compiling the corresponding examinations in the territorial bodies of the Ministry of Internal Affairs of Ukraine;
• to provide the necessary information on the carriage of dangerous goods to other transport entities and to the authorities specified in Articles 10, 15 and 16 of this Law, in the case of road transport - to the bodies of the National Police.

What should the recipient take care of?

The recipient of the dangerous goods must:

• provide special training, advanced training and medical examination of persons engaged in the acceptance of dangerous goods;
• obtain the permit (certificate) for the right to work with the specified pesticides and agrochemicals;
• have a medical book with the conclusion of the medical commission about the absence of contraindications for health reasons to carry out such activities.
