There have been reports in the media that from 2022, besides an application, additional documents will be required to apply for a fuel storage license. In particular, the act of facility’s commissioning or the act of facility’s readiness for operation.

Referring to the final provisions of the Law of Ukraine "On State Regulation of Production and Circulation of Ethyl, Cognac and Fruit Alcohol, Alcoholic Beverages, Tobacco Products, Liquids Used in Electronic Cigarettes and Fuel" the authors of the publications recall that permission to obtain a license to produce fuel, the right to wholesale or retail fuel or the right to store fuel without the submission of such an act was temporary - until January 1, 2022.

The UAC explains that, in fact, from the beginning of 2022, businesses that store fuel for third parties (oil depots, etc.) will have to submit such documents. However, these requirements do not apply to agricultural producers who use fuel for their own needs.

"The procedure for obtaining licenses for various activities, including fuel storage, is regulated by Article 15 of the law. It contains a list of documents, copies of which must be attached to the application for a license. However, in the same article there is a paragraph (added at the initiative of the UAC) which states that businesses that store fuel that is not sold to others and used exclusively for personal consumption or industrial processing, do not submit copies of above-mentioned documents. They need to state in the application that the fuel is used for their own needs, indicate the total capacity of tanks and their actual location. That means, nothing is changed for farmers - they do not need to submit any additional documents to the application for a license," said the adviser to the UAC Chairman Dmytro Kokhan.
