UAC experts have prepared amendments to the second reading of the Draft Law #9015 "On Amendments to the Law of Ukraine "On Financial Mechanisms for Stimulating Export Activity" on Insurance of Investments in Ukraine against Military Risks", which was recently adopted by the Verkhovna Rada of Ukraine as a basis. Together with the Ministry of Agrarian Policy and Food of Ukraine, the UAC participated in its preparation. The UAC proposes to expand the range of agricultural products eligible for ECA export support.

Draft Law No. 9015 aims to introduce instruments to insure investments of both foreign and domestic investors against military risks through the Export Credit Agency (ECA), which is an important tool to promote investment and economic growth in Ukraine.

The current version of the Law of Ukraine "On Financial Mechanisms for Stimulating Export Activity" states that the ECA does not support the export of goods characterized by the Ukrainian Classification of Goods of Foreign Economic Activity (UCG FEA) codes specified in the law. This list of "prohibited codes" currently includes a significant number of agricultural products.

Taking into account the above, the UAC submits for the second reading amendments to expand the range of agricultural products covered by the ECA support. It is proposed to exclude the following items from the list of "prohibited codes":

  • 0102 (Cattle, live);
  • 0103 (Pigs, live); 0104 (Sheep and goats, live);
  • 0201 (Meat of cattle, fresh or chilled);
  • 0202 (Meat of cattle, frozen);
  • 1101 00 (Flour of wheat or of a mixture of wheat and rye);
  • 0203 (Pork, fresh, chilled or frozen);
  • 0204 (Lamb or goat, fresh, chilled or frozen);
  • 0206 (Offal of edible cattle, pigs, sheep, goats, horses, donkeys, mules, fresh, chilled or frozen:)
  • 0207 (Meat and edible offal of poultry);
  • 0401 (Milk and cream, condensed and without added sugar or other sweeteners);
  • 1001 (Wheat and mixture of wheat and rye (meslin);
  • 1201 (Soybeans, crushed or uncrushed);
  • 1205 (Rapeseed or colza seeds);
  • 1507 (Soybean oil and its fractions, refined or unrefined, but without change in their chemical composition);
  • 1512 (Sunflower, safflower or cottonseed oils and their fractions, refined or unrefined);
  • 1514 (Rapeseed oils);
  • 2306 (Oilcake and other solid waste and residues obtained during the extraction of vegetable or microbial fats and oils).

The implementation of the provisions of the draft law will help to attract investment in Ukraine (both foreign and domestic investors) in the context of martial law and post-war recovery. This will support and stimulate the recovery of the agricultural sector, among other things.
