The Vyshnevyi Sad Farm in the Kharkiv region has been operating for more than 25 years and specializes in the cultivation of grain, legume, and oilseed crops. The farm manages over 1,100 hectares of land, with its main crops including wheat, barley, oats, corn, peas, and sunflower.
The farm planned to apply for the state program providing partial compensation for the purchase of Ukrainian-made agricultural machinery and equipment. However, a practical question arose regarding how to confirm eligibility for the increased compensation rate of 40% of the machinery’s value, given that part of the farm’s land is located in territories where active hostilities are ongoing or have previously taken place.
To avoid mistakes during the preparation of the application package, Vyshnevyi Sad Farm contacted the UAC legal advisory hotline, which operates within the framework of the project supporting Ukrainian agricultural producers from war-affected regions in partnership with the international humanitarian organization Mercy Corps.
UAC experts explained that, in order to qualify for the 40% compensation rate, an agricultural producer must meet specific criteria. On the date of application, the producer must own or legally use land plots, at least 80% of which are located in territories classified as areas of possible or active hostilities, and the business must also be registered in such territories.
At the same time, the current compensation procedure does not specify a separate list of documents that agricultural producers must provide to confirm the location of their land plots within these territories. Therefore, UAC experts provided the farm with a practical step-by-step approach.
In particular, they recommended obtaining information from the State Register of Proprietary Rights to Immovable Property through a state registrar using the farm’s company registration code (EDRPOU). This information should contain records of registered land-use or ownership rights along with the location of the land plots.
The experts also explained that information regarding land located in combat-affected territories is available through the State Agrarian Register (DAR) in the “Plots on the Map” section. However, the system currently does not allow users to generate a separate report confirming this status.
In addition, UAC specialists emphasized that applications for partial compensation must be submitted through an authorized bank that processed the payment for the machinery or equipment. Supporting documents must include proof of payment, an acceptance-transfer certificate for the machinery, and, where applicable, a vehicle or machinery registration certificate.
"The consultation helped our farm understand the steps that need to be taken before submitting the application, where to obtain confirmation regarding our land plots, and what issues require special attention when preparing the documentation. Proper confirmation of the location of land plots may directly affect the amount of state support available when purchasing agricultural machinery," representatives of the farm noted.
