Today, more than 250 representatives of agricultural enterprises took part in the webinar "Land Relations in 2021", which was organized by the UAC.
The UAC Legal Adviser on Land Issues Victoria Kipriianova in details analyzed the information about agricultural land turnover and mentioned it to agricultural producers.
According to her, 4,882 agreements are the current figure that shows the situation of the land market.
“On the official website of the StateGeoCadaster (as of September 9, 2021) is mentioned that since July 1, 2021, 14,229 agreements on the alienation of agricultural lands have been concluded in Ukraine. This is a big number. The above-mentioned number of agreements also included inherited land plots, lands for farming, for personal farming, and individual horticulture. However, only 4,882 agreements (with a total area of 16,757 hectares) were concluded. Those contracts were concluded on lands for farming, lands that were alienated by donation, exchange and purchase. That means, 4,882 agreements are the current figure that shows the state of the land market," the expert said.
According to Victoria Kipriianova, all the necessary registers are working today and 4,888 notaries (as of September 9, 2021) have gained access to the data of the StateGeoCadastre of Ukraine in order to obtain information about land plots and entities that own it.
"Today, many farmers complain that for various reasons they cannot conclude a contract on land purchase. I note that all registers work, agreements are concluded. The possibility and efficiency of agreements concluding does not depend on the work of information systems. It depends on buyers and how quickly they give the necessary documents to certify the transaction," she explained.
Victoria Kipriyanova also used the example of public data to show how much land plots were bought by individuals and legal entities during the moratorium on the sale of agricultural land.
“According to the general monitoring of the State Geocadastre, 6,967 ha (1,413 land plots) is the largest amount of agricultural land owned by an individual as of nowadays. 5,153 ha (2,616 land plots) - the largest number of agricultural lands owned by a legal entity. For the most part, this land was acquired before July 1, 2021. We see a clear example how one person was able to accumulate such a large amount of land in his hands during the moratorium on the sale of agricultural land. Therefore, it once again confirms that the land market must exist and everyone must have equal access," she said.
During the webinar, the expert explained how to calculate the limit of 100 hectares in one hand, what to do if the tenant is a legal entity and cannot be a buyer of land until 2024. She also acquainted the participants of the UAC with the recommended changes to lease agreements, spoke in detail about a preferential right and the procedure of its transfer, as well as the requirements for a land purchase contract, etc.
